TERMS OF SERVICE

1. Introduction and Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you and House And Land Packages Pty Ltd (ABN 92 631 641 408) ("HALP"). By accessing or using any of our websites, platforms, or services, you agree to be bound by these Terms.

For Advertisers, these Terms also include the Listing Agreement, which is incorporated by reference. If there is any inconsistency regarding listing specifics, the Listing Agreement prevails.

Applies to www.halp.com.au, www.boutiquedevelopments.com.au, associated mobile applications and any related websites in our network. You must be at least 18 to use our services. We may modify the Terms; material changes will be notified via email and displayed on the site.

2. Description of Services

HALP operates property discovery and business directory platforms — property search, off-the-plan and new-development information, school zone data, calculators, mortgage broker connections, business directory listings, lead generation and CRM integration. HALP is an information and advertising platform, not a real estate agent, developer, builder or financial advisor.

Property listing inquiries route directly to the listing advertiser; HALP does not store those. Platform inquiries (Contact Us, Join Us, Advertise With Us) are managed by HALP per our Privacy Policy. Services are provided "as is" and "as available".

3. User Accounts and Registration

Provide accurate information, keep credentials secure, one account per person, business accounts need a valid ABN/ACN. We may suspend or terminate accounts for breach.

4. User Conduct and Prohibited Activities

Use lawfully and in good faith. Do not misuse the platform (bots, scraping, unauthorised access), post harmful or misleading content, engage in illegal or abusive conduct, or misuse our services commercially. Violations may result in suspension, termination, content removal or legal action.

5. Property Listings and Information

Listings are third-party content. We do not verify all listing information or endorse specific properties. Property information may change without notice — always verify critical details with the property provider before making decisions.

6. Business Directory Listings

Advertisers must hold a valid ABN/ACN, be a legitimate operating business, comply with Australian Consumer Law, and provide accurate information. Listings must not be misleading, unlicensed or infringing. Free and premium subscriptions available. We may remove or suspend listings for breach.

7. Payment Terms (Advertiser Subscriptions)

Pricing is as displayed on our website or the Listing Agreement, in AUD, generally exclusive of GST. Payments are processed via Stripe (PCI-DSS Level 1). Subscriptions auto-renew unless cancelled. No refunds for voluntary cancellations; pro-rata refunds for technical issues preventing access, processed within 14 business days.

8. Intellectual Property Rights

HALP owns or licenses all content, marks, code and design on our platforms. You get a limited, non-exclusive, non-transferable, revocable licence to use the platforms for personal, non-commercial purposes. User-generated content: you retain ownership; you grant us a worldwide, royalty-free licence to use, reproduce and display it.

9. Disclaimers and Limitations

HALP does not provide financial, mortgage, investment, legal, tax or real estate advice. Calculators provide estimates only. School zone data is for research only — verify with the education department and the specific school.

10. Limitation of Liability

To the maximum extent permitted by law, HALP is not liable for direct, indirect, consequential or incidental damages. Where liability cannot be excluded, total liability is capped at $100 AUD for free services, or for paid services the lesser of $1,000 AUD or the amount you paid in the prior 12 months. Nothing excludes rights under the Australian Consumer Law.

11. Dispute Resolution

Contact legal@halp.com.au and allow 30 days for informal resolution. Governed by the laws of New South Wales, Australia; exclusive jurisdiction of NSW courts. Optional arbitration in Sydney under ADRA rules. Class-action waiver to the extent permitted by law.

12. General Provisions

These Terms, together with our Privacy Policy and referenced policies, are the entire agreement. Severability, no waiver, assignment (you may not without our consent; we may to affiliates or in a sale). Notices to legal@halp.com.au.

13. Special Terms for Specific Services

Mortgage calculators are estimates only, not pre-approvals. School zone data is for reference only — always verify. Property alerts are consent-based. Home loan referrals may earn HALP a referral fee; brokers are independent and licensed.
